California overtime law explained

California overtime rules under Labor Code section 510 are stricter than federal law. Most hourly (non-exempt) employees earn overtime by the day, not just by the week. This California overtime calculator applies all of these rules to your workweek so you can check whether your paycheck is correct.

Worked examples

  • Five 10-hour days at $25/hr: 40 regular hours ($1,000) plus 10 overtime hours at $37.50 ($375) equals $1,375.
  • One 14-hour day at $25/hr: 8 hours at $25 ($200), 4 hours at $37.50 ($150) and 2 hours at $50 ($100) equals $450 for the day.
  • Seven 8-hour days at $25/hr: the first 40 hours are regular ($1,000) and the other 16 are overtime at $37.50 ($600), for $1,600.

Regular rate, bonuses and break premiums

Overtime is based on your regular rate of pay, not just your base wage. A flat-sum bonus, such as an attendance bonus, increases the regular rate. Under California case law (Alvarado v. Dominos Pizza), the bonus is divided by the non-overtime hours worked, so overtime hours are then paid at 1.5x or 2x the higher rate. If your employer did not provide a legally required meal or rest break, you are owed one extra hour of pay at your regular rate for each type of violation per day. That premium is not overtime.

Alternative workweek schedules and exempt employees

  • Alternative workweek (such as 4×10): a properly adopted schedule moves daily overtime to the scheduled shift length, but double time still starts after 12 hours. Healthcare employees on an approved 12-hour schedule are paid double time beyond 12 hours.
  • Exempt employees: executives, administrators and professionals must meet duties tests and earn at least $70,304 per year in 2026, which is twice the state minimum wage for full-time work. Salary alone does not make someone exempt.
  • No waiver: California employees cannot agree to waive overtime pay.

California overtime calculator FAQ

How is overtime calculated in California?

Hours over 8 in a day, over 40 in a week, and the first 8 hours on the seventh consecutive day are paid at 1.5 times your regular rate. Hours over 12 in a day and over 8 on the seventh day are paid at double your regular rate.

Does California have double time?

Yes. California is the only state with broad statutory double time, after 12 hours in a day and after 8 hours on the seventh consecutive workday.

Do I get overtime for working over 40 hours if no day exceeds 8 hours?

Yes. Weekly overtime applies to hours over 40 in a workweek, so six 7-hour days (42 hours) earns 2 hours of overtime.

Can my employer make me waive overtime?

No. Overtime rights cannot be waived by agreement in California.

What is the minimum overtime rate in California?

At the 2026 state minimum wage of $16.90, the lowest legal overtime rate is $25.35 per hour and double time is $33.80. Local minimum wages raise these figures, as shown on the map above.

Does California tax overtime differently?

No special withholding applies. Overtime is taxed as regular wages, and California does not allow the federal overtime income tax deduction on its own return. Use our paycheck calculator to see take-home pay.
